Road Accident Fund Claims

The following individuals are eligible to claim compensation:

● Drivers, passengers, or pedestrians injured in a road accident due to another driver’s fault
● Dependants (e.g. spouse, children, parents) of someone who died in a road accident
● Legal guardians or curators on behalf of minors or incapacitated victims
● Claimants acting on behalf of deceased estates
Note: A driver who caused the accident due to their own negligence may not claim, except for limited medical expenses in some cases.

Depending on the nature of the injury or loss, the following types of compensation may be available:

● Medical expenses (past and future)
● Loss of earnings or future income
● Loss of support for dependants of a deceased victim
● Funeral expenses
● General damages for pain, suffering, and disfigurement (only in serious injury cases as defined by the RAF Act)

Road Accident Fund claims must typically be lodged within:

● 3 years from the date of the accident (if the identity of the driver is known)
● 2 years from the date of the accident (if the identity of the driver is unknown – “hit and run”)
